Welcome to the Home Fragrance HQ website (the “Site”), operated by Home Fragrance HQ – a division of the Velderra Group (“we”, “us”, or “our”). By accessing or using this Site, you agree to be bound by these Terms of Use (“Terms”) and by our Privacy Policy and Cookie Policy. If you do not agree with any part of these Terms, please do not use the Site. These Terms constitute a legally binding agreement between you and Home Fragrance HQ.

1. Acceptance of Terms

By using the Site, you affirm that you have read, understood, and agree to be bound by these Terms, including all policies referenced herein. Your use of the Site confirms your acceptance of these Terms, which form a binding agreement between you and Home Fragrance HQ.

Released Parties Defined: “Released Parties” include Home Fragrance HQ, a division of the Velderra Group, and its affiliates, subsidiaries, officers, employees, agents, partners, and licensors.

YOU EXPRESSLY UNDERSTAND AND AGREE THAT:

  • (A) Your use of the Site is at your sole risk, and the Site, as well as any products and services offered through the Site, are provided on an “as is” and “as available” basis. The Released Parties expressly disclaim all warranties of any kind, whether express or implied, including, but not limited to, warranties as to the quality, performance, merchantability, fitness for a particular purpose, or non-infringement of any warranties relating to the products or services listed on the Site.
  • (B) The Released Parties make no warranty that:
    (i) the Site will meet your requirements;
    (ii) the Site will be uninterrupted, timely, secure, or error-free;
    (iii) the results obtained from your use of the Site will be accurate or reliable;
    (iv) the quality of any products or services available on the Site will meet your expectations; or
    (v) any errors in the Site will be corrected.
  • (C) Any material downloaded or otherwise obtained through your use of the Site is accessed entirely at your own discretion and risk, and you will be solely responsible for any damage to your computer system or mobile device that results from the download or use of such material.

10. Limitation of Liability

YOU EXPRESSLY UNDERSTAND AND AGREE THAT THE RELEASED PARTIES WILL NOT BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES—even if Home Fragrance HQ (a division of the Velderra Group) or the Velderra Group has been advised of the possibility of such damages—resulting from:

  • (i) your use of, or inability to use, the Site;
  • (ii) the cost incurred in obtaining substitute goods and services resulting from any goods, data, information, or services obtained through, from, or as a result of the Site;
  • (iii) unauthorized access to or alteration of your User Content;
  • (iv) any statements or conduct of any user or third party on the Site;
  • (v) your reliance on the content made available by us on the Site; or
  • (vi) any other aspect relating to the Site.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. Accordingly, some of the aforementioned limitations may not apply to you. To the fullest extent possible by law, the Released Parties’ maximum liability arising out of or in connection with the Site or your use of the content—regardless of the cause of action (whether in contract, tort, breach of warranty, or otherwise)—will not exceed £10. The Released Parties’ maximum liability with respect to any product and/or service-related claim shall not exceed the cost of the original purchase of said product and/or service.

11. Indemnification

You agree to indemnify, defend, and hold harmless Home Fragrance HQ and the Velderra Group, including their affiliates, and their officers, directors, employees, contractors, agents, licensors, service providers, subcontractors, and suppliers, from and against any and all losses, liabilities, expenses, damages, and costs (including reasonable attorneys’ fees and court costs) arising from or related to:

  • Your User Content or your use of the Site in violation of these Terms;
  • Any technical disruption of the Site or the systems transmitting the Site caused by you;
  • The transmission of any virus or harmful code by you to the Site.

Home Fragrance HQ and the Velderra Group reserve the right, at their sole discretion and expense, to assume exclusive defence and control of any matter otherwise subject to indemnification; in such cases, you agree to cooperate fully with them in defending such claim.

12. Jurisdiction; English Language

The Site is controlled by Home Fragrance HQ – a division of the Velderra Group – from its offices located in the United Kingdom. These Terms and your use of the Site are governed by the laws of England. If you access the Site from outside the United Kingdom, you do so at your own risk and you acknowledge that local laws may not be applicable. The original and controlling version of these Terms shall be in the English language. All communications, notices, and other documents under these Terms must be in English, and their interpretation shall be based solely on the English language version.

13. Entire Agreement

These Terms, along with any policies or operating rules posted on the Site, constitute the entire agreement between you and Home Fragrance HQ (a division of the Velderra Group) with respect to your use of the Site, and supersede any prior or contemporaneous communications, whether oral or written.

14. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, the remaining provisions shall remain in full force and effect.

15. Changes to These Terms

We reserve the right to amend or update these Terms at any time. All changes will be posted on this page with an updated “Effective Date.” Your continued use of the Site after any such changes constitutes your acceptance of the new Terms.
